Understanding the Utah probate process

Probate is the process of obtaining authority to handle the affairs of someone who has died with assets that require proper authority to transfer.

Probate involves submitting a will to the probate court, appointing an executor of the estate, identifying and collecting assets of the deceased person, paying debts and settling claims of creditors, and transferring property and assets to the heirs and beneficiaries.

The process can take anywhere from a couple of weeks up to a year or more depending on the size of the estate, the number of creditors, and the level of cooperation of the beneficiaries.
